First MDL Vioxx Trial Set for Nov. 28 in Houston

HOUSTON - The first federal Vioxx case to be heard by a jury will get underway Nov. 28 in Houston, according to a pretrial order issued by MDL Judge Eldon E. Fallon. Plunkett v. Merck & Co. Inc., No. 05-4046 (E.D. La.).
According to the Sept. 30 order, eight jurors will be chosen to hear argument in the case brought by Evelyn Irvin Plunkett whose husband, Richard, died of an apparent heart attack after taking Vioxx.
