Pharmacy Says It Can't Be Held Liable for Plaintiff's Celebrex Injury Claims

PHILADELPHIA - A pharmacy named as a defendant in a Celebrex personal injury suit is seeking dismissal from the case, arguing that the plaintiffs failed to indicate in their complaint that the pharmacy even sold the drug that caused the alleged injury. Daniels v. Pfizer, Inc., et al., No. 05-2217 (E.D. Pa.).
In a motion to dismiss filed June 17, Rite Aid Corp. contends that Lynnellen Daniels' complaint for damages cause by her ingestion of Celebrex is devoid of any factual allegation upon which a valid claim against Rite Aid could be based.
