TYLER, Texas - A Texas judge has ruled that a man who suffered a heart attack after ingesting Celebrex may proceed with his case in state court because his complaint contains valid claims against the physician who allegedly prescribed the drug. Carey v. Pfizer Inc., et al., No. 05-81 (E.D. Texas).
In a May 16 order, Judge Michael H. Schneider of the U.S. District Court for the Eastern District of Texas held that George Carey and his wife, Paula, alleged sufficient medical malpractice claims under Texas law against the doctor, thereby precluding the court's jurisdiction over the case.
