Merck, Plaintiff File Motion to Continue Alabama Vioxx Trial

ASHLAND, Ala. - The Vioxx case that was expected to be the first in the country to go to trial next month in Alabama state court will likely be postponed at the request of a federal judge, sources told HarrisMartin Publishing.Rogers v. Merck & Co., Inc., No. CV-03-073 (Ala. Cir. Ct., Clay Cty.).
According to sources, Merck and plaintiff Cheryl Rogers have agreed to postpone the May 23 trial date at the request of Judge Eldon E. Fallon, who is currently overseeing the Vioxx MDL in the U.S. District Court for the Eastern District of Louisiana.
