Judge Dismisses Enbrel Negligence Claims, Allows Defect Claims

NEW ORLEANS - A federal judge has dismissed part of a complaint against the manufacturers of Enbrel, after determining that certain negligence claims included in the plaintiff's complaint are barred by the requirements of the Louisiana Products Liability Act. Pompey v. Immunex Corporation, et al., No. 04-3357 (E.D. La.).

In a decision issued Jan. 25, Judge Carl J. Barbier of the U.S. District Court for the Eastern District of Louisiana granted a motion by defendants Immunex Corp., Amgen Inc., and Wyeth to dismiss Victoria Pompey's claims for negligent marketing and testing of the drug, which allegedly caused Pompey to lose …
