New Jersey Court Sets Initial Scheduling Order for Medical Monitoring Class Action

ATLANTIC CITY, N.J. - The New Jersey judge overseeing discovery for more than 300 Vioxx-related injury claims has entered a case management order setting a schedule for a medical monitoring class action recently added to the proceedings. Sinclair, et al. v. Merck & Co., Inc., No. ATL-L-3771-04-MT (N.J. Super. Ct., Atlantic Cty.).

Atlantic County Superior Court Judge Carol E. Higbee entered the order Jan. 25 and gave plaintiffs until Feb. 28 to file their motion for class certification and supporting brief. Plaintiffs have granted defendant Merck & Co., Inc. an extension of time to file its answer to the complaint, …
