SHREVEPORT, La. - A federal magistrate has recommended that the majority of a multi-plaintiff Celebrex personal injury case be dismissed for failure to state a claim under state law. Bell, et al. v. G.D. Searle and Company, et al., No. 04-0701 (W.D. La.).

Magistrate Judge Roy S. Payne of the U.S. District Court for the Western District of Louisiana recommended that Celebrex manufacturer Pfizer Inc.'s motion to dismiss claims for negligence breach of express warranty, conspiracy and misrepresentation be granted, along with a claim for violation of Louisiana's Unfair Trade Practices Act (LUTPA).
