5th Cir. Asked to Decide Whether Arava Claims Against Pharmacists Are Valid

BATON ROUGE, La. - Plaintiffs in an Arava personal injury case have filed a notice of appeal in the Fifth Circuit U.S. Court of Appeals, challenging a decision earlier this year that dismissed several pharmacy defendants from the suit. Guidry v. Walgreen Louisiana, et al., No. 04-31098 (5th Cir.).
Carol and George Guidry filed the notice of appeal on Oct. 21 in federal appeals court after Judge Ralph E. Tyson of the U.S. District Court for the Middle District of Louisiana reiterated in a one-page order that the Guidrys were precluded from recovering damages against pharmacists named in their complaint.
