Vioxx Plaintiffs Move to Thwart Physicians' Motion to Dismiss

NEW ORLEANS - Plaintiffs in an Alabama Vioxx suit that was recently transferred to the MDL are opposing a motion to dismiss filed by three physicians, arguing that the medical negligence claims asserted against the doctors are viable. Hadley, et al. v. Merck & Co. Inc., et al., No. 05-4775 (E.D. La.).

The opposition brief, filed Feb. 22 in the U.S. District Court for the Eastern District of Louisiana, says that dismissing the prescribing physicians simply because they claim the plaintiffs are not serious about pursuing claims against them ignores the sound basis for their causes of action.
