MINNEAPOLIS - A Minnesota judge has adopted a magistrate's recommendation to deny Merck & Co.'s motion for summary judgment filed in a case where an Illinois woman claimed she suffered an acute myocardial infarction as a result of taking Vioxx. Glover v. Merck & Co., Inc., No. 03-5166 (D. Minn.).
In an order entered Oct. 8, Judge James M. Rosenbaum of the U.S. District Court for the District of Minnesota rejected Merck's contention that the magistrate erred when on Aug. 31 he recommended applying Minnesota's six-year statute of limitations to plaintiff Carolyn Glover's products liability claim.
