Federal Judge Remands Dilantin Cases to State Court

PHILADELPHIA - A Pennsylvania federal judge has remanded two phenytoin personal injury actions against Mylan Pharmaceuticals and its corporate parent to state court, ruling that there is not complete diversity because the parent company is a Pennsylvania citizen. Kuresa-Boon v. Mylan Pharmaceuticals Inc., et al., Nos., 08-1452 and 08-2692 (E.D. Pa.).

Judge James T. Giles of the U.S. District Court for the Eastern District of Pennsylvania remanded the cases on Aug. 14 after determining that Mylan's parent, Mylan Laboratories Inc., had not been fraudulently joined.
