BIRMINGHAM, Ala. - A suit alleging injuries caused by the ingestion of Wyeth's Robitussin was untimely filed and the plaintiff has not established a sufficient basis to toll the applicable statutes of limitations, an Alabama federal judge has ruled. Love v. Wyeth, No. 06-AR-0298-S (N.D. Ala.).
Judge William M. Acker of the U.S. District Court for the Northern District of Alabama held that the plaintiff failed to prove he suffered from insanity at the time of his injury.
