LOUISVILLE, Ken. - Schwarz Pharma Inc. cannot be held liable for injuries allegedly caused by the generic equivalent of its gastric reflux drug Reglan (metoclopramide), a Kentucky federal judge ruled June 30. Morris v. Wyeth Inc., et al., No. 1:07-CV-176-R (W.D. Ken.).
Judge Thomas B. Russell of the U.S. District Court for the Western District of Kentucky ruled that, in the generic drug context, Kentucky does not recognize a cause of action against a manufacturer for statements concerning its own product, based on an injury caused by another manufacturer's product.
