HRT Claims Stayed While Court Weighs Appeal in Parallel Proceeding

MINNEAPOLIS - A federal judge in Minnesota has agreed to stay two hormone replacement therapy cases while a Pennsylvania court of appeals rules on whether the plaintiffs' parallel state court proceedings are barred by a less forgiving two-year statute of limitations. Manalo v. Wyeth, et al., No. 07-4557 (D. Minn.).
In an order entered July 9, Judge James M. Rosenbaum adopted the recommendation of a magistrate judge to put the claims on hold and protect the plaintiffs from potentially running afoul of Minnesota's six-year limitations period should the Pennsylvania state court reverse the dismissal.
