Reglan Maker Not Liable for Injuries Caused by Generic, Judge Rules

ATLANTA - The manufacturer of a brand-name drug cannot be held liable for injuries allegedly suffered by a woman who took the drug's generic equivalent, a federal judge had ruled. Swicegood v. Pliva Inc., et al., No. 07-1671 (N.D. Ga.).
Judge Thomas W. Thrash Jr. of the U.S. District Court for the Northern District of Georgia said in his April 2 opinion that he would not depart from state and federal law which states that a manufacturer of a brand name drug is not required to ensure that labeling on the generic manufacturer's drug is accurate.
