LOS ANGELES - A California judge has transferred a lawsuit filed against drug maker Amgen Inc. after determining that the transactions which led to the company's alleged unlawful off-label promotion of Epogen and Aranesp more likely occurred in the state where the plaintiffs reside. Ironworkers Local Union No. 68 v. Amgen Inc., No. 07-5157 (C.D. Calif.).
Judge Philip S. Gutierrez of the Central District U.S. Court ruled Jan. 22 that factors such as the location of non-party witnesses and the location of those allegedly affected by the off-label promotion that should be considered utmost in determining where the claims are …
