Documents Reviewed Prior to Seroquel Depo Not Privileged, Judge Says

ORLANDO, Fla. - Documents the defense used to prepare a pharmaceutical company employee for deposition are not privileged and should be disclosed to a plaintiff who sued the company for injuries allegedly caused by Seroquel, a federal judge has ruled. In re Seroquel Products Liability Litigation, MDL No. 1769 (M.D. Fla.).
Magistrate Judge David A. Baker of the U.S. District Court for the Middle District of Florida said in his Jan. 24 opinion that Seroquel manufacturer AstraZeneca failed to show that the documents reviewed in preparation created a "real non-speculative danger" of revealing counsel's thoughts.
