Judge Conditionally Denies AstraZeneca Preemption Motion

ORLANDO, Fla. - A judge overseeing the Seroquel MDL has denied AstraZeneca's motion for summary judgment based on federal preemption, but has given the defendant an opportunity to raise the argument at a later date. In Re: Seroquel Products Liability Litigation, No. 06-1769 (M.D. Fla.).
In a Nov. 6 order, Judge Anne C. Conway of the U.S. District Court for the Middle District of Florida held that the motion for partial judgment on the pleadings based on federal preemption is premature and extends beyond the parameters argued by the parties at a recent hearing.
