NEW YORK - After plaintiffs and defendants in the Rezulin MDL failed to reach an agreement on what identifying information would be redacted from subpoenaed medical documents, Judge Kaplan has made the decision for them. In re: Rezulin Products Liability Litigation (MDL No. 1348), No. 00cv2843 (S.D. N.Y.).
The Jan. 10 pretrial order provided, inter alia, that any information that attorneys for the subpoenaed parties believed might lead to the discovery of the patient's identity could be redacted, so long as opposing counsel was given sufficient information and time to challenge the decision.
