Judge Gives Second Chance to Neurontin Plaintiffs' Fraud Claims

NEW YORK - A state court judge has ruled that plaintiffs allegedly injured by Neurontin may be able to plead fraud causes of action against manufacturer Pfizer Inc., given the drug's regulatory history and evidence that it was illegally marketed for off-label use. Delaney, et al. v. Pfizer Inc., et al., No. 117852/04 (N.Y. Sup. Ct., New York Cty.).
New York County Judge Marcy Friedman reached the conclusion in a July 11 opinion, dismissing two plaintiffs' fraud claims against Pfizer, but with leave to replead the fraud claims once discovery has been completed in parallel federal proceedings. Judge Friedman also …
