CHICAGO - An expert who linked a diabetic's arterial thrombosis to two Remicade injections the plaintiff received to treat his Crohn's disease failed to employ a methodology deemed reliable under Daubert in arriving at his opinion, a federal appeals court has held. Ervin v. Johnson & Johnson Inc., et al., No. 06-2820 (7th Cir.).
The Seventh Circuit U.S. Court of Appeals on July 9 affirmed a district court's decision to exclude Dr. Lee McKinley's causation opinion as unreliable, and determined that the trial court had properly awarded summary judgment to Remicade maker Johnson & Johnson and its subsidiary Centocor.
