PHILADELPHIA - A judge has thrown out a $3 million verdict awarded to a plaintiff who claimed that she developed breast cancer as a result of taking Wyeth's Prempro hormone replacement therapy. Nelson v. Wyeth, No. 040101670 (Pa. Ct. Comm. Pls., Philadelphia Cty.).
Philadelphia Common Pleas Court Judge Ricardo Jackson granted a motion for JNOV on May 30, a little over three months after jurors returned a verdict in favor of 67-year-old Ohio resident Jennie Nelson. Nelson and her husband accused Wyeth of failing to warn doctors and the public of breast cancer risks associated with Prempro.
