Parties Ordered Not to Destroy Fosamax Documents

NEW YORK - Parties in the Fosamax litigation have been reminded of their obligation to preserve all evidence that may be relevant to lawsuits filed over the osteoporosis drug until such time that an agreement has been reached on preserving such date. In Re: Fosamax Products Liability Litigation, MDL No. 1789 (S.D. N.Y.).
The reminder came courtesy of a case management order issued Nov. 2 by U.S. District Judge John F. Keenan who is overseeing the pre-trial proceedings centralized in the Southern District of New York.
Judge Keenan had previously ordered that nothing related to Fosamax was to be destroyed …
