OTTAWA, Ill. - The Appellate Court of Illinois has affirmed a trial court's order dismissing a plaintiff's claim against Wyeth for allegedly fraudulently marketing and selling Phenergan Expectorants as cough and cold medications, finding that the plaintiff failed to prove that the medications had injured him. Gredell v. Wyeth, et al. No. 1-05-2332 (App. Ct. Ill., Third Div.).
On Aug. 23, the Appellate Court affirmed the Circuit Court of Cook County's order, finding that Gordon Gredell failed to prove a consumer fraud action because he did not show that he suffered injuries from Wyeth's allegedly fraudulent conduct. Gredell had sued …
