PHILADELPHIA - A Pennsylvania court has reversed a lower court's order dismissing a Texas couple's thimerosal claim, saying the trial court erred in finding "weighty reasons" for dismissal on forum non conveniens grounds. Wright, et al. v. Aventis Pasteur Inc., et al. No. 1752 EDA 2005 (Pa. Sup. Ct.).
The Superior Court of Pennsylvania found on Aug. 2 that the Philadelphia Court of Common Pleas erred in concluding that a Texas court would be more convenient for witnesses or that the defendant pharmaceutical companies had insufficient ties to Pennsylvania.
