MONTGOMERY, Ala. - Two Kmart pharmacists are seeking to dismiss an Alabama man's failure to warn claim, arguing that the plaintiff cannot show a causal relationship between their conduct and his alleged injury. Blankenship v. Pfizer Inc., et al. No. 2:06-cv-0648 (M.D. Ala.).
In their motion to dismiss filed July 21 in the U.S. District Court for the Middle District of Alabama, pharmacists Art Redding and Kelli Strange say plaintiff Robert Blankenship cannot prove that their failure to notify him of Mirapex's possible side effects caused his alleged injury.
