WASHINGTON, D.C. - A 7-year-old Missouri boy and his mother have settled their vaccine injury claim for $43.1 million to be paid by the National Vaccine Injury Compensation Program, HarrisMartin is reporting. Rodriguez v. Secretary of Health and Human Services. No. 03-00087 (U.S. Claims Ct.).
Mario and Claudia Rodriguez were awarded $1,475,000 for past medical expenses and $607,989 for future medical expenses. Past medical expenses will be paid by Medicaid liens by the Fund, sources said, adding that the remaining $41,017,011 will be put into a trust fund over time by the Vaccine Injury Compensation Fund.
