NASHVILLE, Tenn. - An initial case management order outlining deadlines for discovery, filings and responses was recently signed by a Tennessee magistrate judge in five plaintiffs' claim against Merck & Co. Inc. for alleged Fosamax injuries. Wolfe, et al. v. Merck & Co. Inc. No. 3:05-cv-0717 (M.D. Tenn.).
On March 7, Magistrate Judge E. Clifton Knowles of the U.S. District Court for the Middle District of Tennessee signed the CMO, which states that this action will be conducted in two phases - the first phase will address class certification and the second phase will address the merits.
