Wyeth: DTC Advertising Evidence Should be Excluded

LITTLE ROCK, Ark. - Wyeth has moved to exclude evidence regarding its direct-to-consumer advertising, arguing that it does not apply to the first two cases set for trial because the plaintiffs testified they did not rely on DTC advertising when deciding to take hormone therapy drugs. In re: Prempro Products Liability Litigation. MDL No. 1507. Case No. 4:03-cv-01507; Reeves v. Wyeth. No. 4:05-cv-00163; Rush v. Wyeth. No. 4:05-cv-00497, (E.D. Ark.).

"The simple answer is that, if Plaintiffs did not see and rely on Wyeth's direct-to-consumer advertising, then that evidence is irrelevant and should not go to the jury," Wyeth said.
