PHILADELPHIA - A Pennsylvania judge recently denied remand to a Pennsylvania couple suing Wyeth for injuries their minor daughter allegedly suffered from the company's vaccines, finding that diversity jurisdiction exists because Wyeth's principal place of business is in New Jersey. Bruesewitz, et al. v. Wyeth Inc. No. 05-5994 (E.D. Pa.).
On March 27, Judge Michael M. Baylson of the U.S. District Court for the Eastern District of Pennsylvania denied Russell and Robalee Bruesewitz's motion to remand, finding that Wyeth met its burden to prove that its principal place of business is in New Jersey, not Pennsylvania.
