Wash. Judge Dismisses Some Claims Against Wyeth in PPA Lawsuit

SEATTLE - A Washington district court judge recently dismissed three product liability claims against Wyeth in a plaintiff's lawsuit against the company for alleged PPA-related injuries. In re: Phenylpropanolamine (PPA) Products Liability Litigation. MDL No. 1407; London v. SmithKline Corp., et al. No. 2:05-cv-00163 (W.D. Wash.).

On Feb. 27, U.S. District Court for the Western District of Washington Judge Barbara J. Rothstein granted in part Wyeth's motion for judgment on the pleadings. Judge Rothstein dismissed all counts against Wyeth except plaintiff Cathie London's allegations of strict liability for insufficient testing and instructions, and misleading advertising.
