Ill. Federal Judge Denies Boehringer’s Motion to Dismiss Pradaxa Suit

BENTON, Ill. — An Illinois federal judge has denied Boehringer Ingelheim Pharmaceuticals Inc.’s motion to dismiss a Pradaxa wrongful death case, ruling that the claims of strict liability, negligence and fraud were adequately pleaded and, at this stage, are not barred by the learned intermediary doctrine or comment k. Fitzgibbons v. Boehringer Ingelheim Pharmaceuticals Inc., No. 3:12-614 (S.D. Ill.).

On July 24, Chief Judge David R. Herndon of the U.S. District Court for the Southern District of Illinois further ruled that the complaint sufficiently connects the alleged injury to Pradaxa’s alleged defective conditions.
