Law Firm Says 'Conflict of Interest' Exists in Proposed Zyprexa Settlement

NEW YORK - A New Orleans law firm representing 12 non-MDL Zyprexa plaintiffs moved to dissolve the multidistrict litigation, saying the proposed $690 settlement does not involve all Zyprexa injury claims as previously indicated. In re: Zyprexa Products Liability Litigation. MDL No. 1596. Case No. 1:04-md-01596 (E.D. N.Y.).
Allan Berger & Associates moved on Nov. 16 to dissolve the MDL and/or the plaintiff liaison committee, as well as to stay the settlement of any MDL cases and to lift the stay on discovery.
Sources said a hearing is scheduled for Dec. 13.
