Wyeth: Diet Drug Plaintiffs' Counsel Hiding Behind Confidentiality Privilege

PHILADELPHIA - Wyeth recently moved to compel production of a letter revealing the fee arrangement between plaintiffs' counsel and its expert in the Diet Drugs MDL, saying the document is not privileged as plaintiffs' counsel asserts. In Re Diet Drugs Products Liability Litigation. MDL No. 1203. Case No. 99-20593 (E.D. Pa.).
On Nov. 4, Wyeth moved to compel Napoli, Kaiser, Bern & Associates and Hariton & D'Angelo, both of Great River, N.Y., to produce the letter from the Grievance Committee for the New York State Supreme Court, 10th Judicial District, regarding the fee arrangement between them and Dr. Richard Mueller.
