LITTLE ROCK, Ark. - The judge overseeing the Prempro MDL denied the plaintiffs' petition for class certification on Aug. 30, saying they could not overcome individual issues of fact and law. In re: Prempro Products Liability Litigation, MDL No. 1507. Case No. 4:03-cv-01507, (E.D. Ark.).
Plaintiffs contended that they were 'significantly exposed to proven hazardous substances through the intentional, negligent, or wrongful actions of Wyeth' in marketing Prempro (conjugated estrogens/medroxyprogesterone acetate tablets). They argued that a consumer protection class and a medical monitoring class were appropriate because Wyeth falsely advertised and marketed the hormone replacement therapy drug for decades, and …
