Court Denies Novartis' Motion to Strike Plaintiff's Expert Reports for Rebuttal

NEW ALBANY, Ind. - A federal magistrate judge denied Novartis Consumer Health's motion to strike the plaintiff's expert reports on July 25, saying that the reports sufficiently address issues identified in the plaintiff's rebuttal evidence. Tracy Patton v. Novartis Consumer Health Inc. No. 4:02-cv-47-DFH-WGH (S.D. Ind.).
Plaintiff Tracy Patton suffered a hemorrhagic stroke in August 2000 which she says occurred 'within hours' of consuming Novartis' PPA-containing Tavist-D cough/cold medicine.
