Claimants Committee Joins Creditors and Debtors in Opposing Plaintiffs' Stay Motions in Ephedra MDL

NEW YORK - The Official Committee of Ephedra Claimants on Aug. 5 joined the Debtors and Creditors committees' joint response opposing the ephedra plaintiffs' motions to stay pending appeal an order dismissing class claims. In Re: Ephedra Products Liability Litigation, No. 1:04-md-01598-JSR (S.D. N.Y.)

Plaintiff Melissa Barr filed her complaint in the California Superior Court for Orange County on Aug. 23, 2002, claiming that Twinlab's marketing of ephedra-containing dietary supplements and weight loss products violated state consumer fraud laws because it included false advertising and violated competition statutes. On Nov. 27, 2002, Barr filed for class certification.
