Pa. Man's Motion for Class Certification Denied in 'Counterfeit' Lipitor Case




PHILADELPHIA - A Pennsylvania Common Pleas judge on May 3 denied class certification in a 'counterfeit' Lipitor case, saying it would not be a 'fair and efficient method' of resolving the claims. Crepeau v. Rite Aid Inc. and H.D. Smith Wholesale Drug Co. No. 1278 (Pa. Comm. Pls., Philadelphia Cty.).

Plaintiff Christopher Crepeau filed a class action complaint in September 2003, alleging he purchased counterfeit Lipitor (atorvastatin calcium) from a Rite Aid pharmacy in Michigan in April 2003.
