AstraZeneca Appeals Order Remanding Okla. Crestor Lawsuit

OKLAHOMA CITY - AstraZeneca is appealing an Oklahoma federal court's decision to reject the pharmaceutical company's fraudulent joinder assertion and remand a Crestor lawsuit on the basis of diversity jurisdiction. Nerad v. AstraZeneca Pharmaceuticals Inc., et al. No. 04-CV-01674-T. (W.D. Okla.).
Ron Nerad sued AstraZeneca in November in the District Court of Canadian County, Okla., claiming the cholesterol-reducing drug Crestor (rosuvastatin calcium) was unreasonably dangerous and caused him unspecified injuries.
He contended that AstraZeneca failed to properly warn consumers about potential side effects, failed to exercise ordinary care in its manufacture, testing and sales.
