Wyeth Granted Ex Parte Communication with Plaintiffs' N.C. Doctors

HACKENSACK, N.J. - Wyeth's request for ex parte communication with several plaintiffs' doctors was granted in part on April 27 by the New Jersey Superior Court judge presiding over that state's consolidated fen-phen cases. In re: Diet Drug Litigation. Master Docket No. BER-L-13379-04MT [Brigman v. Wyeth, BER-L-2547-04MT] (N.J. Super., Bergen Cty., Law Div.).
Wyeth may conduct ex parte interviews with 13 plaintiffs' physicians in North Carolina, Superior Court Judge Charles J. Walsh said. Wyeth can discuss issues 'relevant to the respective parties burden of proof' as well as 'any other medical records that have already been disclosed,' he said.
