NEWARK, N.J. - GlaxoSmithKline has removed to federal court a product liability action in which a New Jersey woman alleges injury from her use of the Advair Diskus asthma inhalant. Neaves v. GlaxoSmithKline Corp., et al., No. 05-CV-1275(AET) (D. N.J.).
GSK filed the removal notice on March 2, asserting complete diversity of citizenship and maintaining that plaintiff Peggy A Neaves' personal injury claims raise the amount in controversy beyond the federal court's $75,000 threshold.
Neaves brought suit in the New Jersey Superior Court, Monmouth County, on Jan. 24, alleging injuries from her use of Advair. She contends that the product …
