LEBANON, Ind. - An Indiana trial court has denied certification to a putative class of plaintiffs alleging addiction and other injury from Purdue Pharma's OxyContin pain medication. Johnson v. Abbott Laboratories, No. 06C01-0203-PL-89 (Ind. Cir. Ct., Boone Cty.).
Boone County Circuit Judge Steve David concluded on Dec. 31that Sandra Alvarez and two co-plaintiffs failed to demonstrate that a class action would be preferable to individual actions, or that class members could meet typicality, numerosity or other criteria for certification under Indiana Trial Rule 23.
