Appellate Court Declines to Hear Metabolife's Appeal of Discovery Order

TALLAHASSEE, Fla. - Florida's 1st District Court of Appeal has denied Metabolife International leave to appeal a trial court's order compelling the diet supplement company to turn over internal documents sought by plaintiffs in a personal injury case. Metabolife International Inc. v. Holster, et al. (No. 1D04-1918, Fla. App., 1st Dist.).

Angela Holster contends that her ischemic stroke was linked to her use of a Metabolife diet supplement, which contained ephedrine. The substance has since been removed from Metabolife products and banned for use by the U.S. Food and Drug Administration.
