WASHINGTON, D.C. - The U.S. Supreme Court has denied Mark and Cheryl Miller's appeal of summary judgment awarded to Pfizer Inc. in a lawsuit blaming their son's suicide on the Zoloft antidepressant. Miller v. Pfizer, Inc., No. 03-1505 (U.S. Supr.).
The Supreme Court issued its order on Oct. 4, denying the Millers' petition for writ of certiorari without opinion.
The 10th Circuit affirmed summary judgment for Pfizer on Feb. 4, finding that the Millers had ample opportunity to address issues that led to the exclusion of expert testimony prior to the trial court's Daubert hearings. (No. 02-3092, 10th Cir.).
