NEW YORK - A New York trial court has dismissed a Rezulin lawsuit as time-barred after concluding the personal representative of the deceased patient failed to serve Pfizer within the statutory time limit. Santo v. Pfizer, No. 105159.04 (N.Y. Sup., N.Y. Cty.).
New York Supreme Court Justice Helen E. Freedman said in her Aug. 12 order that Patricia Santo was bound by a six-month time limit imposed by New York's Civil Practice Law and Rules Section 205(a).
