FRESNO, Calif. - A California appellate court has lifted a stay sought by a Utah supplement maker defending itself against false advertising claims brought by a California teachers group. Teachers for Truth in Advertising v. Basic Research, et al., No. F043604 (Calif. App. Ct., 5th Dist.).
In vacating the stay granted by the Mariposa County Superior Court, California's Fifth Appellate District ruled July 15 that 'nothing in the record overcomes the substantial weight afforded to a resident plaintiff's choice of a California forum.'
