Supplement Maker Seeks Remand of Case Transferred to MDL

NEW YORK - Traditional Medicinals, a company that manufactures an ephedra-containing tea, moved to remand a wrongful death suit on June 18, claiming that it was not made aware that the case was transferred to the MDL until after the 15-day period to oppose transfer had expired. In re: Ephedra Products Liability Litigation, MDL No. 1598 (S.D. N.Y.).
The supplement maker also contends that the case should not be litigated with other ephedra injury actions because its product, Breathe Easy herbal tea, is dissimilar from the weight loss and performance enhancement products involved in other cases in the MDL proceeding.
