MDL Judge Establishes Guidelines for PPA Remand Proceedings

SEATTLE - The federal judge presiding over the PPA MDL on June 22 established the guidelines and criteria for remanding qualified cases to state court. In re: PPA Products Liability Litigation, MDL 1407 (W.D. Wash.).
U.S. District Judge Barbara Rothstein stated that the litigation has sufficiently matured since the MDL was established because a substantial amount of generic discovery has been completed with respect to multiple defendants. In addition, a procedure for case-specific discovery has been implemented and the Court has ruled on Daubert motions regarding the reliability of plaintiffs' medical experts' opinions.
