Judge Finds Serzone Plaintiffs Meet Jurisdictional Threshold

DALLAS - A Serzone injury case involving 43 plaintiffs will remain in federal court, after a judge ruled that it was facially apparent from the complaint that the plaintiffs are seeking damages in excess of the jurisdictional amount. Antwine et al. v. Bristol-Myers Squibb Co. et al. No. 04-CV-0072 (N.D. Texas).
U.S. District Judge Edward Kinkeade denied the plaintiffs' motion to remand June 21, finding that the aggregation of the requested economic damages, trebled economic damages, costs for medical monitoring and attorneys fees, as well as punitive damages would exceed $75,000 per plaintiff.
