PHILADELPHIA - The Pennsylvania Superior Court affirmed a trial court's ruling that dismissed with prejudice the claims of a proposed class of individuals seeking to recover damages based on their children's alleged thimerosal-induced injuries, finding that the plaintiffs' cause of action was under the jurisdiction of the National Childhood Vaccine Injury Act. Ashton, et al. v. Aventis Pasteur Inc., et al. No. 1969 EDA 2003 (Pa. Super. Ct.).
